We are writing to formally let you know that the owner has discovered damage within their property in the form of cracking and structural movement. Building Validation Solutions have been appointed by the owners buildings insurers to investigate the cause of this damage and find a solution to prevent further damage. From our investigations to date we have concluded that the damage has been caused by clay shrinkage subsidence and that vegetation growing within your land is involved.
You will appreciate that all vegetation removes moisture from the ground. If the underlying subsoil is shrinkable clay then shrinkage of the soil will follow. Soil shrinkage is a form of subsidence and when it occurs below the foundations of a building cracking and structural movement can occur. To stabilise the building, the vegetation would need to be removed or subject to future management.
We have completed excavations adjacent to the subject property to inspect the soil supporting its foundations and have confirmed the presence of clay subsoil and root activity under the foundations of the building. We have identified roots from your vegetation within the soil under your neighbour's house foundations. A copy of the root ID is attached for your information. An expert arboricultural view has been obtained from JCA Ltd and a copy of the report is attached for your information.
The following recommendations have been made for vegetation in your ownership:
- T1 (remove) - T2 (remove)
Our engineering appraisal is attached for your information.
We are seeking your co-operation in completing the recommended works. We would be pleased if you could confirm by return that you are agreeable and that you intend to complete these works. We also consider you have a legal liability for damage caused by tree root nuisance and our principals may wish us to pursue recovery of costs in the future.
