Road Surface and Driveway outside 14-16 Beech Tree Road

I’m posting to this site to alert the council that the roadside has deteriorated along a length of 21 feet of asphalt and driveway, next to 14/16 Beech Tree Road. Accompanying this post are some photographs depicting the damage, along with some measurements and points of reference.

The damage had been caused by the driveway’s constant and repeated use as a turning circle for large vehicles - such as the weekly waste collection trucks reversing into Rosetti Place, directly across the road.

As one of the photos show, the proximity of passing vehicles are dangerously close to the damaged area. As the road is frequently used by cyclists and is a potential trip hazard to pedestrians, there is a danger of a serious accident due to a failed surface.

Under Section 41 of the Highways Act (1980), the council has a duty of care to maintain its roadways - and as it has now been pointed out as a potentially dangerous issue, it is imperative for them to put right the damage as soon as possible.

Due to the gravity of the situation and the responsibility of the council, it is to be reminded that any incidents that may arise because of a lack of action by the relevant department may be liable to legal action from those affected, and indeed investigation and possible prosecution by authorities in accordance with HSE guidelines.
